Welcome to www.smileclinicusa.com (the "Site"). The Site is owned and operated by ROBERTS MANAGEMENT LLC ("Smile Clinic USA," "we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of the Site. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Who May Use the Site
The Site is intended for users who are at least 18 years of age and located in the United States. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. By using the Site, you represent that you meet these requirements and that all information you provide is accurate and current.
2. No Dentist–Patient Relationship
Using this Site does not create a dentist–patient relationship. Submitting a contact form, requesting a consultation, reading our content, or communicating with us by email or text message does not by itself make you a patient of Smile Clinic USA.
A dentist–patient relationship is established only after you have been seen in person at one of our offices (or through a properly conducted virtual consultation, where permitted by law), completed our intake and consent paperwork, and been formally accepted for care by a licensed treating provider.
3. Informational Purposes Only — Not Medical or Dental Advice
All content on the Site — including descriptions of procedures such as dental implants, 3 on 6™, and All-on-4® treatments, blog posts, videos, guides, FAQs, and answers to general questions — is provided for general educational and informational purposes only. It is not dental, medical, or professional advice, and it is not a substitute for an in-person examination, diagnosis, imaging, or treatment plan from a licensed dentist or physician.
Never disregard or delay seeking professional advice because of something you read on the Site. Always consult a qualified provider about your individual condition.
4. Medical Emergencies
Do not use this Site, our contact forms, email, or text messaging to report a dental or medical emergency. These channels are not monitored around the clock and messages may not be reviewed for an extended period.
If you are experiencing a medical or dental emergency, call 911 or go to the nearest emergency room immediately. For urgent but non-emergency dental concerns, call your Smile Clinic USA office directly during business hours.
5. Contact Forms, Consultation Requests, and Communications
5.1 Requests Are Not Appointments
Any consultation request, callback request, or contact form you submit is a request only. No appointment is scheduled, confirmed, or reserved until a member of our team contacts you and you receive a confirmation from us directly. We reserve the right to decline or reschedule any request.
5.2 Do Not Send Sensitive Health Information
Email, text messages, and unencrypted web forms are not secure and are not an appropriate channel for protected health information. Please limit what you send us through the Site to basic contact details and a general description of your interest. Do not transmit detailed medical or dental history, images of your mouth, insurance identifiers, Social Security numbers, or payment card information through these channels. Information you choose to send us anyway is sent at your own risk, and we cannot guarantee its confidentiality in transit.
5.3 Consent to Be Contacted
By providing your phone number or email address to us through the Site, you consent to receive communications from Smile Clinic USA and our authorized representatives at that number or address — including calls, text (SMS/MMS) messages, and emails regarding your inquiry, appointment scheduling and reminders, treatment and financing information, and related practice communications. You agree that such communications may be delivered using an automatic telephone dialing system or prerecorded or artificial voice, where applicable.
Consent is not a condition of purchase or of receiving any dental services. Message and data rates may apply, and message frequency varies. You may opt out of text messages at any time by replying STOP, and may reply HELP for assistance. You may unsubscribe from marketing emails using the unsubscribe link in any such email. Opting out of marketing messages does not stop transactional messages related to care you are already receiving.
5.4 Your Content
You are responsible for anything you submit to the Site, including form entries, reviews, testimonials, and photographs. You agree not to submit anything unlawful, defamatory, infringing, or that contains another person's private information without their permission. By submitting content to us, you grant Smile Clinic USA a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting the practice, unless we have agreed otherwise with you in writing. We may remove or decline to post any submission at our discretion.
6. Individual Results Vary
Before-and-after photographs, patient testimonials, case studies, and treatment timelines shown on the Site depict the experiences of specific individuals. They are not a guarantee, warranty, or prediction of the results any other person will achieve. Outcomes depend on factors including bone quality and quantity, oral and general health, healing response, habits such as smoking, and adherence to post-operative instructions. Candidacy for any procedure can only be determined after an in-person clinical evaluation and imaging.
Any statement of cost, financing terms, treatment duration, or number of visits shown on the Site is a general estimate only and is not a quote or an offer. Financing is offered through independent third-party lenders, is subject to their approval and terms, and we do not provide financial or credit advice.
7. Intellectual Property
The Site and all of its contents — text, graphics, logos, photographs, video, page layout, and software — are owned by Smile Clinic USA or its licensors and are protected by U.S. copyright, trademark, and other intellectual property laws. "Smile Clinic USA," "3 on 6™," and our logos are our trademarks or those of our licensors. "All-on-4®" and other third-party marks are the property of their respective owners.
You may view, download, and print Site content for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, modify, frame, scrape, or create derivative works from the Site without our prior written permission.
8. Acceptable Use
You agree not to:

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please note that our Privacy Policy addresses information collected through the Site. Protected health information created or received in connection with treatment is governed separately by HIPAA and by our Notice of Privacy Practices, which you will receive as a patient.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, SMILE CLINIC USA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of harmful components. We do not warrant that Site content is complete, current, or accurate; clinical information changes over time, and content may not reflect the most recent developments.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SMILE CLINIC USA AND ITS OWNERS, DOCTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
This Section does not apply to claims arising out of the professional dental care we provide to patients. Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for professional negligence, gross negligence, willful misconduct, or personal injury to the extent such limitation is prohibited by applicable law. Some jurisdictions do not allow certain exclusions or limitations, so parts of this Section may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Smile Clinic USA and its owners, doctors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any such dispute is the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction there.
Claims relating to professional dental care are excluded from this Section and are governed by the applicable law of the state in which care was provided, including — for care provided in Utah — the Utah Health Care Malpractice Act (Utah Code Title 78B, Chapter 3, Part 4) and its notice and prelitigation requirements.
16. Changes to These Terms
We may update these Terms at any time. The "Last Updated" date above will reflect the most recent version, and material changes will take effect when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. Please review this page periodically.
17. Changes to the Site
We may modify, suspend, or discontinue any part of the Site at any time without notice or liability.
18. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of our right to do so later.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smile Clinic USA regarding your use of the Site and supersede any prior agreements on that subject.
